Facts
Athanasios Kalfelis (plaintiff) purchased futures contracts from a Luxembourg-based bank, Bankhaus Schröeder, Münchmeyer, Hengst International SA (Bankhaus) (defendant), through various intermediaries, including a German-based bank. After sustaining losses, Kalfelis filed suit against Bankhaus and the intermediaries, including the Germany-based bank, in a German court, alleging breach of contract, tort, and unjust enrichment. Bankhaus challenged the jurisdiction of the German court. The action was stayed while the jurisdictional questions were referred to the appellate court for a preliminary ruling.
