Facts
J. R. Atkins (plaintiff) owned the MV Martha Anne, and Ludvig Lorentzen (defendant) owned the steamship Ceara. The Martha Anne sheered—that is, veered off the expected, steered course—and collided with the Ceara. It was unclear whether the accident could have been avoided by the captain or crew of either ship. Atkins and Lorentzen both charged the other with negligence and sought damages in district court. The district court awarded damages to Lorentzen, and Atkins appealed.
