Facts
ATS, Inc. (plaintiff) obtained and properly recorded a money judgment against Keith Canfield. A few months later, Canfield sold some land to James Kent (defendant). Kent financed his purchase by mortgaging the land to Union Planters National Bank (Union Planters) (defendant). ATS sued Kent and Union Planters to establish the judgment lien’s priority. The trial court entered judgment for ATS. Kent and Union Planters appealed to the Tennessee Court of Appeals.
