Facts
The American company Attorneys Trust (plaintiff) sued a Taiwanese company, Videotape Computer Products, Inc. (VTP) (defendant), to collect a debt owed to another Taiwanese firm, CMC Magnetic Corporation (CMC). VTP filed a California cross-complaint to bring CMC into the litigation. Based on California’s substantive law, the federal district court ruled in VTP’s favor. On appeal to the Ninth Circuit, CMC argued that under the United Nations Convention on Contracts for the International Sale of Goods, the district court should have applied Taiwan’s substantive law to the case.
