Facts
Grady and Lillie Auvil et al (plaintiffs) represent a group of apple growers (growers) in the state of Washington. On February 26, 1989, CBS 60 Minutes (CBS) (defendant), a news show, aired a story criticizing the growers for their use of Alar, a chemical sprayed on apples. The show stated Alar is known to cause cancer in people exposed to the chemical. After CBS aired the show, consumer demand for apples declined dramatically, and the growers lost millions of dollars. In November 1990, the growers filed suit against CBS asserting a claim for product disparagement. The district court granted summary judgment for CBS, and the growers appealed.
