Facts
Private citizens initiated a criminal action and a labor action against Avon Products Inc. (plaintiff) in Dominican Republic courts. [Ed.’s note: The casebook excerpt does not provide a description of the underlying conflict, but suggests it was a labor dispute.] The Second Chamber Labor Court of the National District (defendant) issued a judgment against Avon Products. Avon Products then filed a petition for a writ of protection with the Dominican Republic Supreme Court, alleging that the Second Chamber Labor Court violated Avon Products’ constitutional rights, including its right to due process. At the time Avon Products petitioned the Supreme Court for the writ of protection, Dominican Republic’s law did not expressly recognize such a type of action and did not have a procedure for such action. Avon Products was asking the Supreme Court to issue a writ of protection for the first time under Dominican Republic law, and Avon Products pointed to the American Convention on Human Rights (the convention) for support of this new type of action.
