Award in ICC Case No. 4491
Panel of Arbitration
2(1) J. Int'l Arb. 75 (1985)
- Written by Mary Katherine Cunningham, JD
Facts
The plaintiff and the defendant entered a licensing agreement with an arbitration agreement. A dispute arose, and the parties referred the dispute to a panel of arbitration in London, England. The defendant raised certain statute-of-limitation defenses. The plaintiff objected, arguing the defendant could not raise any statute-of-limitation defenses because Finnish law was the relevant law of the contract and Finnish law lacks such defenses.
