Facts
Mariano Azada and his wife (plaintiffs) were involved in a car accident with Roger Carson (defendant). Days before the two-year statute of limitations had run, the plaintiffs sued Carson for personal injuries sustained in the accident in the United States District Court for the District of Hawaii under its diversity jurisdiction three months later. Carson then asserted a counterclaim against the plaintiffs. The plaintiffs argued that Carson’s claim was time-barred and filed a motion to dismiss.
