Facts
Backun (defendant) sold Zucker stolen silverware with the intent to have Zucker transport it to the South and sell it to pawnshops there. Zucker was apprehended for selling the stolen silverware, and Backun was later apprehended for his role in the silverware’s sale. Backun was charged and convicted of the crime of transporting stolen merchandise in excess of $5,000 in interstate commerce under the National Stolen Property Act. Backun appealed his conviction, claiming that he was an accessory rather than a principal in the felony.
