Facts
A Hawaii law (marriage law) restricted marital rights to different-sex couples. Ninia Baehr (plaintiff) and other individuals in same-sex relationships sued the Director of the Department of Health, John Lewin (defendant), and Hawaii. Baehr sought a declaration that the marriage law was unconstitutional and preliminary and permanent injunctions against the withholding of marriage licenses to same-sex couples. The circuit court granted Lewin’s motion for summary judgment on the pleadings and dismissed Baehr’s complaint. Baehr appealed.
