Facts
Bahlul (defendant) was convicted by a military commission of the offense of conspiracy to commit war crimes for his involvement in the September 11, 2001, attacks against the United States (plaintiff). The United States Court of Military Commission Review affirmed the conviction. Bahlul appealed his conviction to the court of appeals, on the ground that because conspiracy is not an offense violative of the international law of war, the United States may not make the offense triable by a military commission under Articles I and III of the United States Constitution.
