Facts
Richard John Baker and James Michael McConnell (plaintiffs) applied for a marriage license to marry each other. A court clerk (defendant) denied the license on the ground that the men were of the same sex. Baker and McConnell sought a writ of mandamus to obtain the marriage license. The trial court denied the writ and ordered that a marriage license not be issued to them. Baker and McConnell appealed.
