Facts
The City of Petersburg (the city) (defendant) provided water service to its residents. The city contracted with its county to provide water and sewer services to areas within the county that were outside the city’s limits. In 1975, a developer contracted with the county to extend the city’s extraterritorial water line to a new development outside the city. The city passed an ordinance requiring current and future water and sewer customers to annex their property to the city or risk termination of services. Gregory and Karen Bakies (plaintiffs) bought a home in the new development outside the city and received water and sewer services from the city. The Bakieses refused to annex their property and sued the city seeking an injunction. The court granted the Bakieses a preliminary injunction to halt immediate shutoff of services but later granted the city summary judgment. The court of appeals affirmed. The Bakieses appealed.
