Facts
David Baldwin (plaintiff) was a temporary supervisory air traffic control specialist. Baldwin suspected that he was not chosen for a permanent position because he was gay. Baldwin’s supervisor, who was a part of the selection process, called Baldwin a distraction and told Baldwin to stop talking about “gay stuff” when Baldwin mentioned his male partner. In December 2012, Baldwin filed a formal complaint with the Equal Employment Opportunity Commission, alleging that he had been subject to discrimination based on his sex and sexual orientation.
