Facts
The Ballous (plaintiffs) brought this suit alleging that Jesse Ballou’s death was proximately caused by the negligence of an employee truck driver of Henri Studios (defendant). The Ballous sought to exclude the results of a blood-alcohol test that showed that Jesse’s blood alcohol level was .24% at the time of death. The district court excluded the evidence of the blood test on the grounds that it may not have been reliable and therefore was unfairly prejudicial. Henri Studios appealed.
