Facts
Albert Verduzco (defendant) supervised Daniel Bals (plaintiff) at the Island Steel Company. Verduzco filed multiple evaluation reports on Bals, and Bals was subsequently terminated. Bals brought suit against Verduzco for defamation. At trial, the court granted Verduzco’s motion for summary judgment, finding that Verduzco’s filing of the employee-evaluation reports did not constitute a publishing for the purposes of a defamation action. The appeals court affirmed this decision. Bals appealed.
