Bammert v. Don’s SuperValu, Inc.
Wisconsin Supreme Court
646 N.W.2d 365 (2002)
- Written by Sara Rhee, JD
Facts
Karen Bammert (plaintiff) worked at Don’s Super Valu, Inc. (Don’s) (defendant) as an at-will employee for 26 years. Bammert’s husband worked as a police officer. On June 7, 1997, Bammert’s husband participated in the drunk-driving arrest of Nona Williams, who was the wife of the owner of Don’s. On August 28, 1997, Don’s fired Bammert in retaliation for her husband’s involvement in Williams’s drunk-driving arrest. Bammert sued Don’s for wrongful termination. The Dunn County Circuit Court dismissed Bammert’s complaint for failure to state a claim, because the case did not fall within the public-policy exception to the at-will employment doctrine. The court of appeals affirmed. Bammert appealed.
