Facts
The United States (plaintiff) initiated a grand jury investigation that resulted in multiple indictments against eight defendants, including employees of Bank of Nova Scotia (defendant). Bank of Nova Scotia moved the district court to dismiss the indictments on grounds of prosecutorial misconduct. The district court found prosecutorial misconduct including violations of the Federal Rules of Criminal Procedure and violations of defendants’ constitutional rights. The district court dismissed the indictments. The United States appealed and the court of appeals reversed the dismissal. Bank of Nova Scotia petitioned the United States Supreme Court for review.
