Facts
Clifford Bannister (plaintiff) sued the Town of Noble (defendant) for injuries sustained during a car accident. At trial, Bannister introduced a “Day in the Life” video that depicted him doing normal, day-to-day tasks such as getting around his school, pumping gas, and doing chores in his home. The purpose of introducing the film was to demonstrate how the injury impacted Bannister’s daily life. The trial court ruled in Bannister’s favor. The town appealed, arguing that the video should not have been introduced into evidence.
