Facts
Banta (plaintiff) hired Stamford Motor Co. (Stamford) (defendant) to build a yacht. In the contract, Banta and Stamford agreed that the yacht would be built by September 1, 1911, and that Stamford would pay Banta $15 for each day that the yacht was late. Stamford delivered the yacht to Banta on November 25, 1911. The parties went to trial on the subject of damages, and the lower court ruled in favor of Banta. Stamford appealed.
