Facts
Gene Barany and Helen Elliott (plaintiffs) were members of their credit union’s credit committee. The credit union’s board of directors removed Barany and Elliott from the committee. Barany and Elliott sued under the Federal Credit Union Act for improper removal. The district court dismissed the suit, finding that no private right of action existed under the Federal Credit Union Act. Barany and Elliott appealed.
