Barber v. Barber

United States Supreme Court
323 U.S. 77, 65 S. Ct. 137, 89 L. Ed. 82 (1944)

Facts

Mrs. Barber (plaintiff) secured a judgment of separation from her husband, Mr. Barber (defendant), in a North Carolina court. The judgment, which was later modified, directed Mr. Barber to pay Mrs. Barber monthly alimony. Twelve years later, Mr. Barber stopped paying Mrs. Barber’s alimony. Eight years after that, Mrs. Barber sought the accrued unpaid alimony from the North Carolina court that found Mr. Barber liable to Mrs. Barber for the unpaid alimony. Mrs. Barber then sued Mr. Barber in Tennessee to recover on the judgment for unpaid alimony. The Tennessee trial court gave the North Carolina judgment full faith and credit and ruled for Mrs. Barber. The Tennessee appellate court reversed because it found that the North Carolina judgment lacked the finality that was required for full faith and credit. Mrs. Barber appealed to the United States Supreme Court.
