Facts
Andrae Barnett (defendant) got into an altercation with Kevon Moses. Barnett picked up a garden hoe and approached Moses. Moses backed up and tripped. Barnett then hit Moses in the back of his head, which killed Moses. The State of Alabama charged Barnett with felony murder, based on the underlying felony of first-degree assault. The jury convicted Barnett, and he appealed.
