Facts
Barrell (plaintiff) and Benjamin (defendant) were business partners. Barrell was a citizen of Connecticut, and Benjamin was domiciled in Demerara, a British colony. When Barrell and Benjamin dissolved their partnership, Barrell sued Benjamin in contract to recover money that Barrell alleged Benjamin owed to him on settlement of their accounts. Barrell commenced his action in state court in Massachusetts and had Benjamin personally served—by arresting Benjamin’s body—when Benjamin was in Boston, Massachusetts, on his way to Demerara. Benjamin contested personal jurisdiction over himself in Massachusetts.
