Facts
Sports Illustrated was a magazine published by Time, Inc. (Time) (defendant). Articles published in Sports Illustrated detailed allegations and an investigation into the University of San Francisco (USF) basketball team using illegal recruiting methods. The articles republished statements made by Quintin Dailey, a star player for USF’s basketball team, that the head coach at the time, Pete Barry (plaintiff), had been involved in transmitting illegal payments to students, including Dailey. Barry sued Time for libel, arguing that readers would take the allegations as true based on Sports Illustrated publishing them. Time moved for dismissal, and the court granted the motion and held that Barry was a public figure and therefore required to plead actual malice.
