Facts
Margie Wodarz was involved in an automobile accident with Mubarak Bashi and Nasim Akhtar (plaintiffs). Just prior to the accident involving Bashi and Akhtar, Wodarz had been in another automobile accident with a third party and fled the scene. Bashi and Akhtar brought a claim against Wodarz, alleging negligence. At trial, Wodarz claimed that she had no control over her actions at the time and could remember very little about the two automobile incidents. Wodarz brought a motion for summary judgment, arguing that her sudden mental illness meant she was not negligent as a matter of law. The trial court granted the motion, and Bashi and Akhtar appealed the decision.
