Facts
Indiana and Wisconsin did not permit same-sex marriage or recognize same-sex marriages performed outside the state. Rae Baskin (plaintiff) and her same-sex partner were residents of Indiana who wished to marry. A lawsuit was filed on behalf of Baskin and two other same-sex Indiana couples, alleging that Indiana’s refusal to recognize same-sex marriage violated the Equal Protection Clause of the Fourteenth Amendment. The lawsuit named Carol Bogan (defendant), a county clerk, and numerous other defendants. Similar lawsuits were filed in the state of Wisconsin. District courts ruled in favor of the same-sex couples. The cases were consolidated on appeal.
