Facts
Bayou Bridge Pipeline, LLC (BBP) (plaintiff) was building the Bayou Bridge Pipeline. BBP attempted to sign servitude agreements with landowners in the pipeline’s path. BBP filed an expropriation suit against those landowners with whom it could not obtain an agreement (landowners) (defendants). The landowners countersued for trespass. The trial court granted BBP’s petition for expropriation but also found in favor of the landowners on the trespass claim. Ultimately, the trial court awarded each landowner only $75 for expropriation and $75 in damages for the trespass. The landowners appealed. The court of appeal found that, pursuant to state statute, the landowners were also entitled to attorney’s fees and other litigation costs. BBP appealed.
