Facts
Costco sought to build a store in the City of Ridgeland (the city) (defendant). Costco selected a site for its store with the assistance of the city. However, the site that Costco selected was not zoned to permit all of Costco’s desired uses, such as a fueling station. The site that Costco selected was designated as a C-2 district, which did not allow fueling stations. Consequently, the city rezoned the Costco site to C-4, which allowed fueling stations. Gerald Beard (plaintiff) and other residents of the city challenged the reclassification of Costco’s site as C-4, arguing that it constituted an illegal rezoning. The trial court upheld the city’s rezoning. Beard appealed.
