Facts
Margaret Beattie (plaintiff), the spouse of Michael Beattie (defendant), was severely and permanently injured in a car accident in which her husband, who was driving, struck the rear of a slow-moving truck. The trial court granted Michael’s motion for summary judgment and dismissed Margaret’s case under the spousal-immunity doctrine, which prevented one spouse from suing the other in tort. Margaret appealed and urged the court to abrogate the doctrine in Delaware. Michael argued that only the state’s general assembly could effect such changes to well-settled public policy.
