Facts
John W. Beatty lost control of his horse and was killed by an oncoming train. The collision occurred near a railway crossing at which the existing highway and the railway line ran almost parallel. Beatty’s administratrix (plaintiff) sued Central Iowa Railway (Central) (defendant) to recover damages for his death. The trial court found in favor of Central. Beatty’s administratrix appealed. The Iowa Supreme Court granted certiorari.
