Facts
William Becker (plaintiff) worked for Arco Chemical Company (Arco) (defendant). After Arco terminated Becker’s employment, Becker sued Arco for age discrimination under the Age Discrimination in Employment Act. At trial, the district court permitted Becker to introduce evidence regarding the manner in which Arco had terminated the employment of another former Arco employee, Linwood Seaver. The district court permitted the evidence under Federal Rule of Evidence 406. The jury returned a verdict in Becker’s favor. Arco appealed.
