Facts
I.P. Construction Corp. (I.P.), a subsidiary of Interstate Properties (defendant), hired Wood-Pine Corp. to help build a shopping center. Wood-Pine, in turn, hired Windsor Contracting Corp. (Windsor) (defendant). A truck driver employed by Windsor, William Edwards (defendant), accidentally struck and injured an employee of Wood-Pine, Gary Becker (plaintiff). Becker brought suit against I.P., Windsor, and Edwards. Windsor, which was not financially solvent, was incapable of paying damages. Meanwhile, the district court held that I.P. was not liable for the tort of a subcontractor. Becker appealed. The United States Court of Appeals granted certiorari.
