Facts
Stephanie Belcher (plaintiff) sued Sherry Goins (defendant) after Belcher’s mother was injured in a traffic accident with Goins. At the time of the collision, Belcher was 18 and resided with her mother. Belcher was not in or near the traffic accident. Belcher sought recovery from Goins for the loss of her mother’s love, companionship, and consortium and for mental anguish and the cost of services Belcher provided to her mother. Goins moved to dismiss. The trial court denied the motion, but upon joint application of the parties, certified five questions to the West Virginia Supreme Court of Appeals. These five questions asked whether the children of injured parents had claims for loss of consortium, mental anguish, and the value of services provided by the child to the injured parent.
