Belleville Catering Co. v. Champaign Market Place, LLC
United States Court of Appeals for the Seventh Circuit
350 F.3d 691 (2003)
- Written by Joseph Bowman, JD
Facts
Belleville Catering Co. (Belleville) (plaintiff) sued Champaign Market Place, LLC (Champaign) (defendant) in federal court, alleging subject matter jurisdiction based on diversity of citizenship. Belleville’s complaint alleged that Champaign was a citizen of Delaware and Illinois as Champaign was organized under the laws of Delaware and maintained its principal place of business in Illinois. Champaign was a limited liability company (LLC) and not a corporation. Champaign’s members failed to disclose their residency. The district court accepted Belleville’s allegations and heard the case. Belleville appeals the decision in favor of Champaign.
