Facts
Miles Bench (defendant), a convenience-store employee, was tried for killing a customer in a manner that caused intense physical and mental suffering. Bench was convicted of first-degree murder and sentenced to death, the jury’s verdict reflecting both the cruel nature of the crime and a perception of the continuing threat to society posed by Bench. Neuroimaging data revealed anomalies in four parts of Bench’s brain, but Bench’s attorney made no further investigation or presentation of this evidence. Bench appealed, alleging ineffective assistance of counsel. The Oklahoma Court of Criminal Appeals granted certiorari.
