Facts
The County of Los Angeles and Sheriff’s Department Deputy Scott Sorrow (the county) (defendants) were charged with costs for trial technology in a civil Banes Act action brought against them by Noel Bender (plaintiff) after Bender was unlawfully arrested and beaten while he was in handcuffs and not resisting arrest. The county appealed and argued, relying on 20-year-old caselaw—Science Applications International Corporation v. Superior Court—that trial-technology costs are not recoverable and have been specifically disallowed and, therefore, are not within the trial judge’s discretion to award.
