Bender v. Underwood
New York Supreme Court, Appellate Division
93 A.D.2d 747, 461 N.Y.S.2d 301 (1983)
- Written by Steven Pacht, JD
Facts
Robert Bender and five others who underwent a hair-implementation process (patients) (plaintiffs) brought separate suits against Dr. Ricardo Crudo (defendant), claiming that Crudo failed properly to examine and treat them, improperly performed or supervised the implantation processes, falsely stated that the implementation process was safe, and failed to obtain the patients’ informed consents. The patients asked the supreme court to, among other things, consolidate the six actions for joint trial. The supreme court granted the patients’ motion. Crudo appealed.
