Facts
Bennett Regulator Guards, Incorporated (Bennett) (plaintiff) and Canadian Meter Company, Incorporated (defendant) were both manufacturers. Each had developed a spray cover for a gas-regulator pressure valve. Bennett sued Canadian Meter for infringing on Bennett’s patent. Canadian Meter claimed to have publicized its own invention, barring patenting of the invention at all. Specifically, Canadian Meter had sent a memo to a distributor asking for customer feedback on its spray cover and a letter to gas companies telling them they could contact Canadian Meter for any other information they might require. As a result of this evidence, the district court granted Canadian Meter’s motion for summary judgment. Bennett appealed to the United States Court of Appeals for the Federal Circuit.
