Bhadauria v. Board of Governors of Seneca College of Applied Arts and Technology
Ontario Court of Appeal
27 O.R.2d 142, 105 D.L.R.3d 707 (1979)
- Written by Sarah Hoffman, JD
Facts
Pushpa Bhadauria (plaintiff) had a Ph.D. in mathematics and seven years of teaching experience. Over four years, Bhadauria applied for ten teaching jobs at the Seneca College of Applied Arts and Technology. All of the jobs posted by Seneca College had been advertised publicly, and Bhadauria was qualified for all of the positions. Bhadauria was not given a single interview. Bhadauria filed a civil suit against the Board of Governors of Seneca College of Applied Arts and Technology (Seneca) (defendant), alleging that Seneca had breached its statutory duty not to discriminate against her. The trial court dismissed Bhadauria’s claims, and Bhadauria appealed.
