Facts
Ajai Bhatia (plaintiff) and Marlene Debek (defendant) were involved in a custody dispute over their young daughter, T. Debek refused to allow Bhatia to visit with T, and to prevent visitation, she made a series of accusations against him. The parties’ dispute culminated with Debek falsely accusing Bhatia of sexually abusing T. Bhatia was arrested and tried for sexual assault and for risk of injury to a child. The jury acquitted Bhatia of sexual assault but deadlocked on the risk-of-injury charge. The judge dismissed the risk-of-injury charge. Bhatia sued Debek for malicious prosecution. The trial court found for Bhatia, and Debek appealed.
