Facts
Bi-Metallic Investment Company (Bi-Metallic) (plaintiff), an owner of real estate in Denver sought to enjoin the Colorado State Board of Equalization and the Colorado Tax Commission from putting in force and the Denver assessor from obeying an order of the boards to increase the valuation of all taxable property in Denver. Bi-Metallic brought the case on the ground that it was denied its constitutional right under the Due Process clause of the United States Constitution to be heard before being deprived of his property.
