Facts
Jean Bierman (plaintiff) was an elderly woman whose basement was flooded as a result of a ruptured water main. Bierman brought an action in small-claims court against the City of New York (city) (defendant) and the company that had been working on the main, Consolidated Edison (defendant). Bierman sought to recover $300 in damages. There was no proof of negligence.
