Facts
Binney & Smith Company (plaintiff) held a patent claiming both carbon-black pellets—which consisted solely of carbon black—and a process for making them. Binney & Smith brought an infringement action against United Carbon Company (defendant) in federal district court. The court held that the patent’s product claims were invalid due to the lack of a patentable invention. Binney & Smith appealed to the United States Court of Appeals for the Fourth Circuit.
