Facts
Thomas Bondi (plaintiff) was the Chairman of the New Jersey Board of Examiners of Master Plumbers. The board held a public meeting at which it announced that Joseph Fichner, Jr. a master plumber and member of the New Jersey Society of Professional Energy and Environmental Contractors (NJSPEEC), had committed misconduct, fraud, and misrepresentation. Fichner was fined, ordered to pay restitution to clients, and had his license suspended for five years. In the meeting, Antoine Nassimos (defendant), a liaison between the NJSPEEC and the board, accused the board of improperly leaking information about its discipline decision before taking an official action. Nassimos also accused Biondi of having an improper relationship with the NJSPEEC. Nassimos then accused Biondi of having mob connections and of threatening to order a hit on Nassimos if Nassimos did not stop complaining about Biondi. Biondi brought a slander action against Nassimos. Nassimos filed a motion for summary judgment, which was denied. The jury declared a mistrial. Nassimos renewed his motion for summary judgment, and it was granted. Biondi appealed.
