Facts
Peter Biondo (plaintiff) sued the City of Chicago (defendant), claiming racial discrimination in the city’s firefighter’s exam. At a trial for damages, the city called Daniel Garcia as an expert in economics. Garcia planned to testify as to the additional money firefighters would have made if the exam had been race-standardized. Garcia had a Ph.D. from the University of Chicago, where he had taken courses in math and econometrics as well as two courses dealing with applying statistics to labor-market issues. Garcia’s Ph.D. thesis focused on the Argentinian labor market. Garcia had not been published on anything to do with statistics and had not previously been qualified as an expert witness.
