Facts
Walter Hinton’s (plaintiff) goods were destroyed in a fire caused by a train belonging to Birmingham Railway Light & Power (Birmingham Railway) (defendant). Hinton brought suit against Birmingham Railway. At trial, Birmingham Railway requested that if the court should find in favor of Hinton, that the court award only nominal damages for Hinton’s goods. Hinton did produce evidence other than his verbal testimony of the goods’ cost at trial. The court found in favor of Hinton and did not grant Birmingham Railway’s request for nominal damages. Birmingham Railway appealed.
