Black v. Abex Corp.
North Dakota Supreme Court
603 N.W.2d 182 (1999)
- Written by Craig Conway, LLM
Facts
Rochelle Black (plaintiff) filed a wrongful death suit on behalf of her deceased husband, Markus, against Abex Corporation and 47 other corporations (defendants), alleging that (1) Markus was exposed to asbestos-containing products manufactured by defendants during his 15 years in the Air Force as an auto mechanic and (2) that exposure eventually caused his death by lung cancer. Black asserted that each defendant should be held responsible under market share and alternative liabilities theories. The trial court dismissed Black’s complaint for failure to raise a genuine issue of material fact. Black appealed.
