Facts
Fred Hunt Company, Inc. (Fred Hunt) (defendant), a builder-vendor, built a house in Little Rock, Arkansas. On June 29, 1979, J. Ted Blagg and Kathye Blagg (plaintiffs) became the third purchasers of the house. The Blaggs’ purchase occurred less than nine months after Fred Hunt’s original sale. Shortly after the Blaggs took possession of the house, they discovered formaldehyde fumes. It turns out the fumes were the result of a defective carpet and pad. The Blaggs sued Fred Hunt for damages based on implied-warranty and strict-liability claims. Fred Hunt asked the trial court to dismiss the claims. The trial court dismissed the implied warranty claim, and the Braggs appealed.
