Facts
J.E. Jones Construction Company (Jones) (defendant) developed and built homes in a St. Louis County subdivision. Before development, Jones recorded a document with the county reflecting that 150 multifamily dwellings might be built on the tract along with single-family homes. The plat marked a portion of the land “future development” without mentioning multifamily dwellings. Steven Blaine and others (collectively, Blaine) (plaintiffs) purchased homes from Jones. Blaine sued Jones for fraud, alleging that Jones induced Blaine into purchasing their homes by fraudulently concealing its intent to build an apartment complex nearby. The jury found for Blaine. Jones appealed.
